Terms of Service

All information provided through the Services — including dive site descriptions, conditions, tide and current predictions, weather and marine forecasts, ratings, reviews, photos, and any other content — is for general informational purposes only. None of it constitutes professional diving advice, a dive plan, a safety certification, or a representation that any site or condition is safe for you to dive. Environmental predictions in particular are estimates generated from third-party data sources (see our third-party notices) and can be inaccurate, stale, or wrong for the specific conditions at your location and time.

You acknowledge that you are not relying on the Services as your sole or primary source for any diving or snorkeling safety decision. Before every dive, you are solely responsible for independently verifying actual conditions on site, obtaining a local briefing where available, confirming your own training and certification are appropriate for the dive, and using your own judgment — regardless of what the Services show. This is true no matter who is using the Services or what representations they've made to us about their age, training, or experience: the Services simply are not a safety system, for anyone.

Diving and snorkeling carry inherent risks — including serious injury, decompression illness, drowning, and death — that exist independently of any information we provide or fail to provide. By engaging in these activities, you assume those risks voluntarily.

Submissions are assigned to the company. Contributions grant us a broad, royalty-free, worldwide, irrevocable license to use, reproduce, distribute, and display your content in connection with operating the Services.

If you submit a professional-level diving certification (e.g., Divemaster, Instructor, or above) to gain access to Pro Pack, you represent that the certification, the card images you upload, and any information you provide in connection with that submission are genuine, accurate, and belong to you. Submitting a fraudulent, altered, expired, borrowed, or otherwise invalid certification, or fraudulently completing identity verification, is a material breach of these Terms and may result in immediate suspension or termination of your account and Pro Pack access, in addition to any other remedies available to us.

We make no guarantee regarding the accuracy of product details. Products are subject to availability and may be discontinued at any time.

Payments are processed via Stripe. All payments are in USD. We reserve the right to refuse or limit any order.

Pro Pack requires a professional-level certification that we verify before granting access. Submitting a certification for review does not guarantee approval — verification is performed at our sole discretion, and we may reject a submission or request additional documentation. If your submission is rejected, any payment authorization hold placed on your card is released in full and you are not charged. If Pro Pack access is granted on the basis of a submitted certification and that certification is later found to be fraudulent, altered, expired, or otherwise invalid, that access is non-refundable and may be suspended or terminated immediately, regardless of how the certification was originally verified (including by automated review or admin approval).

Scrape or harvest data; impersonate other users or entities; use automated systems to access the Services; commercially exploit any part of the Services; circumvent security features; harass or harm other users; sell or transfer your profile; or engage in any activity that violates applicable law.

These Terms are governed by the laws of the State of Washington.

Before initiating arbitration, parties must attempt informal negotiation for 60 days. Unresolved disputes will be settled by binding arbitration under AAA rules in Kitsap, Washington. No class actions are permitted. All disputes must be initiated within one year of the cause of action arising.
